1. Introduction
These Terms of Service ("Terms") govern the provision of Physiotherapy Services by Waka Physiotherapy ("we", "us", "our") to Clients ("you", "your"). By booking or attending an Appointment, you agree to these Terms.
We provide these Services in accordance with New Zealand Law, professional Physiotherapy standards, and the requirements of the Accident Compensation Corporation (ACC).
2. Scope of Services
We provide Physiotherapy assessment, diagnosis, treatment and rehabilitation services. Treatment plans are developed based on clinical need and may be aligned with ACC approved pathways where applicable.
3. ACC Services and Surcharges
3.1 ACC Coverage
If your injury is accepted by ACC, part of your treatment cost will be funded by ACC in accordance with their regulations and contracts.
3.2 Client Co-Payment (Surcharge)
A $30 Surcharge per Appointment applies to ACC covered treatments. This fee reflects the portion not covered by ACC and is payable by you.
3.3 ACC Requirements
You agree to:
Provide accurate information relevant to your claim
Comply with agreed Treatment Plans and Rehabilitation goals
Attend Appointments as scheduled or provide adequate notice of cancellation
Failure to comply with ACC Requirements may affect your eligibility for funded treatment.
4. Private (Non-ACC) Services
Appointments not covered by ACC are charged $80.00 per session, payable at the time of Treatment.
5. Invoicing and Payments
Payment is required on the day of Treatment unless otherwise agreed upon
We may issues invoices for outstanding payments
Unpaid accounts may be referred to a Debt Collection Agency, with any additional costs recoverable to the extent permitted by Law

7. Cancellation and Non-Attendency Policy
7.1 Minimum Notice
At least 1 hour's notice is required to cancel or reschedule and appointment.
7.2 Late Cancellation / No-Show Fee
Failure to provide adequate notice or non-attendance will incur a $80 Cancellation Fee.
7.3 ACC and Missed Appointments
ACC does not fund missed appointments. You are responsible to for any applicable Cancellation Fees.
7.4 Outstanding Fees
All Cancellation Fees must be paid in full before further Appointments can be made.
7.5 Discretion
We may waive Fees in exceptional circumstances at our discretion.
8. Clinical Records and ACC Compliance
We maintain up-to-date clinical records in accordance with:
ACC Audit requirements
Physiotherapy Board of New Zealand Standards
These records may include treatment notes, progress reports, and outcome measures.
ACC may Audit your treatment records as part of their Provider Review processes.
9. Privacy and Health Information
Your Personal and Health information is collected and managed in accordance with the Privacy Act 2020 and the Health Information Privacy Code.
We may share information with:

Other Healthcare Providers involved in your care
Referrers (where applicable)
This is for the purpose of treatment, claim management, and rehabilitation.
10. Informed Consent
You have the Right to be fully informed about your condition and treatment options.
By proceeding with Treatment, you consent to Physiotherapy Services. You may withdraw consent at any time.
11. Treatment of Minors (Under 16 Years)
11.1 Parental/Guardian Consent
Clients under the age of 16 ("minors") must have consent provided by a Parent of Legal Guardian prior to receiving treatment, unless the minor is legally able to provide informed consent under New Zealand Law.
11.2 Young Persons and Competency
Where a minor is assessed as competent to make informed decisions about their treatment, we may rely on that consent in accordance with applicable Legal and Professional Guidelines.
11.3 Communication with Parents/Guardians
We may communicate with a Parent or Guardian regarding the Minor's condition, treatment, and progress, unless the Minor has the Legal Right to Confidentiality,
11.4 Attendance and Supervision
We may require a Parent, Guardian, or responsible Adult to be present during assessment or Treatment where applicable.
11.5 Safeguarding and Child Protection
We are committed to providing a safe environment for all Minors. We follow appropriate Child Safeguarding practices consistent with New Zealand Standards.
Where there are concerns about the Safety or Well-Being of a Minor, we may take appropriate action, including sharing relevant information with Authorities, in accordance with our Legal obligations.
12. Sideline and Sports Team Services
12.1 Scope of Sideline Care
We may provide Physiotherapy Services in Sporting environments, including sideline assessment, injury management and return to play advice.
12.2 Nature of Treatment
Sideline assessment are often conducted in time-limited and dynamic environments. You acknowledge that:
Assessments may be brief and based on available information
Immediate decisions may be required regarding participation or removal from Play
12.3 Consent for Sideline Treatment
By participating in a Team, Programme, or Event where we are providing Services, you (or your Parent/Guardian, where applicable) consent to receive assessment and treatment in that environment.
12.4 Minors in Sports
For School aged or Youth Athletes, consent is expected to be gained through:
School Enrollment Processes
Sports Team registrations
Direct Parental/Guardian Consent
Where applicable, we will confirm consent. In urgent situations, treatment may be provided in the best interests of the Athlete.
12.5 Communication
We may share relevant injury information with Coaches, Team Management, or School Representatives where appropriate for Player safety, unless confidentiality obligations apply.
12.6 Return-to-Play Decisions
Return-to-play guidance is based on Clinical Judgement and Governing Body Protocols (where applicable). Final decision may involve collaboration between Athlete, Coach, Parent/Guardian, and appropriate Medical Staff (where applicable).
13. Treatment at External Facilities (Gym Based Services)
13.1 Third Party Premises
Some services may be provided from a Gym or Fitness Facility not owned or operated by Waka Physiotherapy.
13.2 Non-Member Access
If you are a non-member of the Facility, you attend as a guest solely for the purpose of Physiotherapy Treatment and you must sign a Responsibility and Liability Waiver upon entering provided by Waka Physiotherapy.
Failure to sign Responsible and Liability Waiver will result in you not being able to receive assessment or treatment within the Fitness Facility.
13.3 Client Responsibility Waiver
By attending an appointment at such facilities, you acknowledge and agree that:
You enter the Premises at your own risk
You must comply with all facility rules, instructions, and safety requirements
Waka Physiotherapy is not responsible for the operation, equipment, or management of the Facility
13.4 Limitation of Liability for Facility Use
To the extent permitted by Law, we are not liable for injuries, loss, or damage arising from your use of the Gym or its equipment outside of the Direct Provision and Supervision of Physiotherapy Services.
13.5 Indemnity
You agree to indemnify Waka Physiotherapy against any Claims arising from your misuse of the Facility or failure to follow safety instructions.
14. Client Rights
Your are entitled to receive Services consistent with the Code of Health and Disability Services Consumers' Rights, including the Right to:
Be treated with respect
Receive Services of an appropriate standard
Make informed choices
Provide informed consent
15. Health and Safety
We comply with the Health and Safety at Work Act 2015. You agree to follow all reasonable instructions to ensure a safe treatment environment.
16. Limitation of Liability
Nothing in these Terms limits your rights under:
The Consumer Guarantees Act 1993
The Health and Disability Commissioner Act 1994
To the extent permitted by Law, we are not liable for indirect or consequential losses

18. Changes to Terms
We reserve the Right to update these Terms. The current Version will be available on our Website.
19. Governing Law
These Terms are Governed by the Laws of New Zealand.
